Investigative Interviews
The OEIG regularly interviews individuals during the course of an investigation. As such, investigators will reach out to interviewees to schedule an interview. Interviewees can bring a union representative, private attorney, or other individual uninvolved with the investigation but should contact the investigator in advance to identify this individual. An interviewee will generally be presented with one or more forms to review and sign including a Request to Record Interview Form and an Administrative Rights Form. These forms can be made available upon request.
State employees have an obligation to cooperate in OEIG investigations (see 5 ILCS 430/20-70), which includes participating in interviews as requested, as well as telling the truth and not withholding information in those interviews. Intentional omissions and knowingly making false statements can be considered failing to cooperate in investigations, which could impede the investigation and is a serious violation of the Ethics Act and Executive Order 16-04.
